GAN Limited and its direct and indirect subsidiaries (collectively, “GAN,” “us,” “we,” or “our”) knows that you care how your information is used and shared. This Privacy Policy explains how we collect, use, retain, and disclose your Personal Information (defined below) collected through our websites and applications, or use any of the products or services we make available to you through our websites and applications (collectively, our “Services”).

1. Scope and Our Roles

For the purposes of this Privacy Policy, we are the “Business” or “Data Controller” with respect to your Personal Information, as we are the organization that determines why and how Personal Information is processed. Please read this policy carefully to understand our policies and practices regarding how we may collect, use, maintain, protect, and disclose your information. This Privacy Policy also describes certain choices and rights you have with respect to your Personal Information. By accessing or using our websites and services where this Privacy Policy is posted, you are agreeing to the collection and use of your Personal Information in accordance with this policy. If you do not agree with our policies and practices, you may choose not to use our services, or you may choose to exercise your rights as disclosed in this policy.

Generally, this Privacy Policy applies to:

  • The processing of Personal Information on our website. 
  • The processing of Personal Information that GAN collects, uses, retains, or discloses about attendees at GAN-hosted events or visitors to GAN facilities. 
  • The processing of Personal Information about Clients or prospective Clients and their representatives.
  • The processing of Personal Information related to subscribers of GAN newsletters or other marketing materials. 

Much of the Personal Information we collect may be considered business-to-business information and may be outside of the scope of state consumer privacy laws in the United States. If you are a California resident, please see the section below titled “Your Privacy Choices and Rights; California Residents” for our Notice at Collection and additional information provided pursuant to California law.


2. Information We Collect 

In our role as a “business” or a “controller,” we collect various types of information, including Personal Information, Usage Information, or Combined Information, about your activities when you visit www.gan.com, general contact and/or communications which you may have with us, and the use of our Services. 

Personal Information

For the purposes of this Privacy Policy, “Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked (directly or indirectly) with you, and may include Usage Information, which we describe below.

The categories of Personal Information that we collect will depend on our interactions with you, but may include:

  • Identifiers and Contact Information, which mainly will include your business contact information, such as your name, email address, and phone number that we use to stay in contact with you. 
  • Commercial Information about your GAN product purchases, and product and service interests, histories, or tendencies including products or services you like or reviews you submit.
  • Geolocation, such as coarse geolocation through your ZIP code or IP address.
  • Audio, electronic or visual information such as a photograph, with your consent when you come to an event and/or provide a testimonial, audio recordings when you call us (but please note we may not be able to associate such recordings with you), and recordings or transcripts of your communications to us or our customer support.
  • Other Information that you submit or otherwise choose to share with us.


We do not generally collect Sensitive Personal Information other than for operational or business purposes. If we do collect this, we will provide you with more specific notice and/or ask for your consent.


Usage Information


“Usage Information” refers to device, internet, and network activity information that we, our business partners, and our service providers collect, including information about how you interact with our Services, emails, advertising, and content. 

Usage Information we collect may include:

Internet, Device and Online Activity Information related to online activities such as browsing history, search history, website pages viewed, visit duration, application usage specifics, and other specifics about your interactions with websites including full Uniform Resource Locators (URLs), clickstream information to, through, and from our website (including date and time); services viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from the page. We also collect device information, such as your internet protocol (“IP”) address information, your browser or operating system information, login information; time zone setting, browser plug-in types and versions, mobile device type, or other information that relates to your interaction with our websites. In some situations, this information may be used or combined in a way that it identifies you, your company, or your position within your company. We may also collect Device Data, such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, device and/or browser type, hardware model, internet service provider and/or mobile carrier, operating system, mobile platform, and system configuration information. This information is primarily needed to maintain the security and operation of our Apps, for troubleshooting and for our internal analytics and reporting purposes. In those situations, such information will be treated like Personal Information, as required under applicable laws.

Log and Usage Data, including service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called “crash dumps”) and hardware settings. 

Combined Information 

We may combine Usage Information with other Personal Information we have about you. If we do, we consider this Personal Information.

We describe how we collect Personal Information and Usage below.

Information You Provide Directly to Us


You may provide your Personal Information in a variety of ways, including when sign up to receive communications from us, contact us, or otherwise use a Service. We also may give you the option of submitting Personal Information of other individuals, such as other employees at your company. We assume that you have the proper consent and legal basis for providing us with this information. 

Information Provided From Other Parties and Public Sources

We may receive Personal Information about you from our affiliated companies; service providers, including chat service, data analytics, and internet providers; vendors, including technical, billing and accounting; and other third-party sources, including commercially available sources. Advertising and social media partners may also give us information about you, and we may combine Personal Information we receive from outside sources with other Personal Information that we have about you for the purposes described in this Privacy Policy.

We may collect information about you from publicly available sources, such as public profiles on social media platforms.

4. Sources of Collection; Cookie Policy

Cookies and Other Tracking Technologies, such as first party and third-party products and services to gather traffic statistics using cookies, pixels, or web beacons. A cookie is a small piece of information stored on your device that helps our websites and multiple servers recognize you. GAN, our Service Providers, and other third parties may also use other tracking technologies such as pixels, or transparent GIF files, for website management and user tracking.

Some of the technologies we use are strictly necessary for the functionality of our websites. Others improve the functionality of our websites but are not strictly necessary. Some cookies help improve the performance of our websites (such as by gathering analytic data), while others help provide targeted advertising services to you (like ads that you may be interested in). Examples of cookies and other tracking technologies we use include:

  • Session Cookies. We use Session Cookies to operate our Services. Session cookies are temporary and are automatically deleted once you close your internet browser.
  • Preference Cookies. We use Preference Cookies to remember your preferences and various settings. Preference cookies are first party cookies that remain on your computer or device until you delete them, or they are otherwise removed upon expiration.
  • Third Party Cookies. GAN permits third-party business partners, advertisers, and other companies to use cookies or other similar technologies on our websites. These companies may collect your information, track your behavior on our websites, and gather information about your use of our websites, and other online services over time and across different services. Additionally, some companies may use information collected to deliver targeted ads on behalf of us or other companies, including on other apps, websites, or online services. We are not responsible for the functioning of cookies and other technologies used and placed by third parties on your device. We do not always control third parties’ collection or use of your information to serve interest-based advertising. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For information about how you can opt out of receiving targeted advertising from many providers, see Your Privacy and Choices. These third parties may provide you with ways to choose not to have your information collected or used in this way. Please refer to Your Privacy and Opt-Out Rights.
  • Pixel Tags, Web Beacons, and Transparent GIFs. Pixel tags and web beacons are tiny graphic images placed on Website pages or in our emails that allow us to determine whether you have performed a specific action. When you access these pages or open or click an email, the pixel tags and web beacons generate a notice of that action. These tools allow us to measure response to our communications and improve our web pages.
  • Other Technologies. We collect many different types of information from other technologies to improve the quality of our Websites and the Services we provide. For example, we may collect usage data and other information about the device you use to access our websites, your operating system and/or mobile device type, browser type, domain, and other system settings, as well as the language your system uses and the country and time zone where your device is located. We may record the IP address of the device you use to connect to the internet.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). 5. How We Use Information 

We use your Personal Information for our business purposes, including to provide and improve the Services that GAN makes available to you, to provide customer service for our Client Services, and respond to your inquiries and requests, to conduct research and data analytics, to prevent fraud and other criminal activity, for marketing purposes and to provide you with personalized offers and recommendations, and for other purposes for which we may notify you unless permitted or required by law.

To communicate with you and authorize access to our Services:

  • Requesting a demo of our products.
  • To answer any questions or inquiries you make to us.
  • Any other purpose you have given us permission to carry out.

To facilitate our business and operational purposes: 

  • To provide Services and support.
  • To maintain and improve our Services, including ensuring their security and integrity.
  • To debug and repair errors that impair the functionality of our Services.
  • To maintain or service accounts, process or fulfill orders and transactions, verify Client information, process payments, provide analytic services, or provide storage.
  • To investigate legal claims.
  • To meet our obligations and enforce our rights arising from any contracts with you, including for billing or collections, or comply with legal requirements.
  • To administer our websites and conduct internal operations, including internal research, troubleshooting, data analysis, testing, research, statistical, and survey purposes.
  • To improve our websites, products, or Services, marketing, or customer relationships and experiences.
  • Undertaking activities to verify or maintain the quality or safety of any service or device that GAN offers to its clients, and to improve, upgrade, or enhance these services or devices.

For our marketing purposes:

  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with privacy and marketing laws.
  • To provide targeted advertisements or other customized content to you on our websites and email communications we send you based on your interactions with our website or Services.
  • To provide you with special offers, marketing or promotional materials, and general information about other goods, services, and events which we offer that are similar to those that you have already purchased or inquired about, or which we believe may be of interest to you, unless you have opted not to receive such information. If you are a GAN Client, we will use your information to provide you with email notifications, promotional messaging, newsletters, and other information from GAN. You may opt out of receiving any, or all, of these communications by [email protected] or by utilizing the “Unsubscribe” links in such email messages.

We may anonymize or aggregate Personal Information so that the information can no longer directly or indirectly identify you. We keep and use such anonymized or aggregated information for our legitimate business purposes as described in this Privacy Policy or in accordance with applicable law.

We may also use your Personal Information in other ways we notify you about at the time we collect your Personal Information.

6. Disclosures

We may disclose your Personal Information to our affiliates and other business partners, service providers, and marketing partners. We may also disclose your Personal Information with other parties to enforce our rights, in connection with a business transfer or merger, for safety or security purposes, or other reasons for which we may notify you from time to time. Our Services employ cookies and tracking technologies to help us improve your experience and understand your interests and to allow GAN and our advertising partners and social media platforms to display relevant advertisements on GAN and others’ websites, apps, or devices you use. Please review the section on “Cookies and Other Tracking Technologies” for more information. 

Subject to restrictions and conditions set out in applicable laws, we may disclose the above categories of Personal Information in the following circumstances:

  • Affiliates. We may disclose your Personal Information to our affiliated businesses and brands, including our direct and indirect subsidiaries.
  • Vendors and Service Providers. We may disclose your Personal Information to our vendors and service providers that provide business services to us, including IT management and data storage, billing and payment processing, data analytics, and to promote our business and optimize our Client Services.
  • Business and Advertising Partners. We may disclose your Personal Information to our Clients, sponsors, and promoters of any competition that we conduct via our Services, and other business partners. We may share hashed information with advertising companies and social media platforms, which may be used to provide you with relevant advertisements. Cookies and tracking technologies may be used on our Services to allow us and our business and advertising partners to collect, use, and disclose information to display relevant advertisements on our Services.3
  • Business Transfer. We may disclose your Personal Information to a prospective seller or buyer in connection with the sale or purchase of a GAN business or asset; with a buyer or other successor in the event of merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, where one of the transferred assets is the Personal Information we hold.
  • Legal, Safety, and Security. If necessary, we may disclose your Personal Information to apply or enforce our rights or other agreements, including to assist us in preventing or investigating fraud; bring or participate in a legal action involving the rights and property of GAN or our affiliates; to protect the rights, property, or safety of our business, our employees, our customers, or others (including exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection, and credit risk reduction); and to comply with any court order, law, or legal process, including responding to any government or regulatory request. This includes disclosures to the gaming commissions in which GAN is licensed. 

We may disclose your Personal Information in other situations with your consent or when we provide you with notice as required by law. We may also share anonymized or aggregated information with others for any legitimate purpose in accordance with applicable laws. 

7. Your Privacy Choices and Rights; California Residents

We aim to provide you with various choices regarding your Personal Information, including your options for advertising and marketing materials.

Promotional Emails 

If you do not want us to use your contact information to promote our own products and services, or third parties’ products or services (in limited circumstances), you may also opt-out of further marketing communications by replying to any promotional email we have sent you or following the opt-out links on that message.

Your Privacy Rights

Your Ability to Access Information: You may request access to your Personal Information and, where technically feasible, request a copy of your Personal Information. You may also have the right to obtain information about how we process or share your Personal Information.

Your Ability to Correct. You may have the right to request that we correct any inaccurate or incomplete Personal Information we have about you. To make a request, contact us using the information provided in the “Contact Us” section at the bottom of this page.

Your Ability to Delete Information: You may have the right to request that we delete your information. Please note that we may not be able to delete certain information depending on legal exceptions or obligations we have to retain your information as described in the “Disclosures” section above. Please see the “Data Security and Retention” section below for more information about why we may retain your information.

Your Ability to Opt-Out of Marketing: You may request that we not use your Personal Information to send you certain emails or other marketing communications. You may also unsubscribe from receiving marketing emails from GAN by clicking on the “Unsubscribe” link found in those emails. Please note you may not be able to opt-out of all communications because we may need to send you information related to our Client Services.

Your Ability to Revoke Consent: You may also withdraw your prior consent to the processing of your Personal Information, including sharing your Personal Information with some third parties (other than our service providers).

Your Ability to Opt-Out of Sale or Sharing / Targeted Advertising: You may request to opt out of the “sale” or “sharing” (as defined by applicable laws) of Personal Information, as well as certain types of behavioral or targeted advertising based on information collected about you on non-affiliated websites, applications, or services. To make a request, click the “Do Not Sell or Share My Personal Information” link in the footer of our U.S. websites, use our webform available here, or contact us using the information provided in the “Contact Us” section below.

Your Ability to Limit the Use of Sensitive Personal Information: You may reques c t that we limit the use or disclosure of Sensitive Personal Information if we use or disclose such information for reasons other than those set forth under the law. We do not use or disclose Sensitive Personal Information for reasons other than the limited purposes allowed under the various comprehensive privacy laws.

Your Ability to Appeal: You may have the right to submit an appeal if you are not satisfied with the outcome of your request. Please send appeals directly to [email protected].

Your Ability to Submit a Complaint to a Data Protection Authority or Attorney General: You have the right to file a complaint concerning the use or storage of your Personal Information. 

Your Right to Non-Discrimination: Unless permitted by law, we will not deny you goods or services; charge (or suggest you may receive) different prices for goods or services, including through granting discounts or other benefits, or imposing penalties; or provide (or suggest you may receive) a different level or quality of goods or services. In California, this includes the right not to receive discriminatory treatment by us for exercising your privacy rights, including an employee’s, applicant’s, or independent contractor’s right not to be retaliated against for the exercise of their state law privacy rights. However, we may offer you certain financial incentives permitted by consumer privacy laws that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. Currently, we do not provide any financial incentives.

California Residents

If you are a California resident, California’s Shine the Light law permits you to request information about how we disclose your Personal Information to other parties for marketing purposes. As described in this Privacy Policy, we may disclose your Personal Information with companies that market or provide products and services for GAN and our Clients. Additional Information for California Residents. California law requires that a business provide in its privacy policy a list of the categories of Personal Information it has in the preceding 12 months (1) disclosed for a business purpose, (2) disclosed in exchange for valuable consideration (considered a “sale” under California law, even if no money is exchanged), and (3) disclosed for cross-context behavioral advertising (considered “sharing” under California law), as well as the categories of third parties to whom each category of Personal Information was disclosed or sold.


Categories of Personal Information.

  • Identifiers and Contact Information: Includes business contact information such as name, email address, and phone number.
  • Commercial Information: Information about product and service interests, histories, or tendencies, such as products or services you like or reviews you submit.
  • Internet Device and Online Activity Information: Includes browsing history, search history, website pages viewed, visit duration, application usage specifics, and other interactions.
  • Geolocation Data: Coarse geolocation through ZIP code or IP address.
  • Audio, Electronic, or Visual Information: May include photographs, audio recordings, and recordings or transcripts of communications.
  • Inferences or Preferences: Derived from interactions with GAN’s services or customer support team.

Sources of Personal Information.

  • Directly from You: When you register for GAN-hosted events, visit GAN facilities, or subscribe to GAN newsletters or other marketing materials.
  • Passively from You: Through your interaction with their Services, customer support, and technologies like cookies.
  • From Other Parties and Public Sources: Including affiliated companies, service providers, and publicly available sources such as social media platforms.

Purposes for Using Personal Information.

  • Service Provision: We use your Personal Information to offer and improve our services for both prospective and existing clients. This includes facilitating access to third-party products or services when relevant.
  • Communication: We communicate with you about our services. This includes providing necessary support and sharing information about products or services that might be of interest to you, provided you've agreed to receive such communications.
  • Legal and Contractual Compliance: We process Personal Information to fulfill our legal responsibilities and uphold our rights from contracts with you, especially for billing, collections, and legal claims. This also covers compliance with our legal or regulatory obligations and defending against legal claims.
  • Operational Improvement: Our goal is to continually enhance the services we offer. We use Personal Information to ensure these services meet contractual obligations and adhere to legal and regulatory standards.

Disclosures of Personal Information.

  • Subsidiaries and Affiliates: We may share your Personal Information with our subsidiaries and affiliates for operational, business, and legal purposes.
  • Service Providers and Contractors: These third parties assist in various aspects of our services, including technical, billing, and operational tasks.
  • Clients and Casino Operators: Certain clients, including casino operators, may access your Personal Information under strict contractual restrictions that govern the use of this information.
  • Advertisers and Advertising Networks: We partner with advertisers and networks for marketing and promotional activities. This may include sharing information that facilitates targeted advertising, in line with your preferences and consent.
  • Analytics Providers: For improving our services, we might share information with analytics providers. This helps us understand user behavior and enhance user experience.
  • Legal Compliance and Rights Protection: In certain circumstances, we may disclose information to other entities as necessary to fulfill our legal obligations, enforce our rights, or defend against legal claims.

Sharing or Sales to Third Parties

Generally, we do not share or sell your Personal Information. There are, however, specific exceptions to this policy:

  • Through Cookies and Tracking Tools: We may “sell” or “share” certain categories of Personal Information through the use of cookies and other tracking tools. This is primarily in the context of our relationships with companies that market or provide products and services for our brands.
  • Coarse Geolocation Data: In some instances, we may share coarse geolocation data, derived from IP addresses, through cookies. You have the option to opt-out of this data sharing.

As defined under California law, you can request to opt out of the "sell" or "share" actions of your Personal Information. To exercise this right, you can click the “Do Not Sell or Share My Personal Information” link in the footer of our U.S. websites, or contact us as outlined in the “Contact Us” section.

Retention of Personal Information.

  • Personal Information is retained as necessary to provide services, fulfill legal obligations, resolve disputes, and enforce rights.


Verifying Your Requests 

GAN will respond to an individual’s “verifiable request” to exercise his or her state privacy rights. A verifiable request means that we have received a request purporting to be from a particular individual, and have been able to verify the individual’s identity.  The need to verify an individual’s identity is critical to protecting your information and ensuring that your information is not shared with anyone pretending to be you or someone who is not authorized to act as your agent on your behalf.

Once you submit your request, we may ask you to provide information about yourself so that we can verify your identity as part of this process.  This information may include your name, your address, and any other information deemed necessary by GAN and our Clients and affiliates to reasonably verify your identity, to ensure that your information is not shared with anyone impersonating you.  Once we have verified your identity, we will work to fulfill your request in a timely manner.  Please note there may be some situations in which we are unable to fulfill your request, such as if we cannot find any information about you within our systems.  Additionally, we may not be able to honor a deletion request in some situations, such as if your information is necessary to fulfill your order with us or meet a legal obligation.  We will inform you whether we can fulfill your rights request.

We may ask for additional information if we have difficulty confirming your identity.  We will not share your information or honor other requests in those situations in which we are unable to verify your identity.

Under certain state laws, a consumer can appoint an “authorized agent” to make certain verifiable requests on their behalf, such as the right to know what information we collect about the consumer or to request deletion of the consumer’s information.    Because the security and privacy of your information is paramount, we will ask that you identify and provide permission in writing for such persons to act as your authorized agent and exercise your applicable rights under applicable state law in such situations.  This may require us to contact you directly and alert you that an individual has claimed to be your agent and is attempting to make a request regarding your information.  We will also independently verify your identity to ensure that an unauthorized person is not attempting to impersonate you and exercise your rights without authorization.  We will not share your information or honor any other requests in those situations where you cannot or do not grant permission in writing for an identified authorized agent to act on your behalf, or where we cannot independently verify your identity.

We attempt to respond to requests no later than 45 days or as otherwise required by law. We will advise you in writing if we cannot meet your requests within this time limit.

8. International Addendum

Consent to Processing, Transfer, and Storage of Information; Disputes

By accepting this Privacy Policy through the use of Services, you agree to the terms of this Privacy Policy, and you expressly consent to the processing, transferring, and storing of your Personal Information according to this Privacy Policy.

We will only transfer Personal Information from the European Economic Area (EEA), United Kingdom (UK) or Switzerland to the United States if one of the following applies: (1) we have entered into an agreement using standard contract clauses approved by the European Commission or a European data protection authority, or by the UK data protection authority for transfer from the UK, or (2) you give your express consent to the transfer. By using the Services, or providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable countries in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside and/or are a citizen.

Purposes and Legal Basis for Collection and Use of Personal Information

To understand the purposes for which we collect and use Personal Information, please refer to the section above titled “Information We Collect and How We Collect It.” With regards to those purposes, we may collect, use, and disclose Personal Data per the following legal basis:

  • To perform our contractual obligations such as managing business relationship with our customers and obtaining professional, financial, technical, administrative or other advice and services in connection with the operation of GAN’s business;
  • To comply with applicable EU or UK legal obligations;
  • For our legitimate interests such as to investigate breaches of this Privacy Policy, to protect our rights and property (e.g. in the context of a corporate transaction), to enforce our terms of use and legal notices, and for the establishment, exercise and defense of legal claims; and
  • On the basis of your consent which you may give from time to time (e.g. for the use of certain cookies) with the possibility to withdraw your consent at any time.

With regards to direct marketing, please note that we will only use your email address or mobile phone number for advertising purposes if you provide us with your prior consent, which you can withdraw at any time.

9. Data Security and Retention

We take reasonable steps to protect the information provided to us. However, no method of transmission over the Internet or method of electronic storage is 100% secure or error-free.
